What is a license appeal?

A license appeal occurs when a caregiver requests a formal review of the decision to deny or revoke their license. Binti can track key dates and important milestones in the appeals process for caregivers in the "Denied" and "Closed (Post Approval)" status.

How do I create an appeal?

To access license appeals, a family must be in the "Denied" or "Closed (Post Approval)" status. When this criteria is met, an appeals section will display on the Change Application Status page. To create an appeal follow these steps:

  1. Locate the caregiver you would like to create an appeal on the Caregiver Applications dashboard
  2. Navigate to Actions > Change Application Status
  3. Ensure the caregiver is in "Applying", "In Renewal Process", "Denied" or "Closed" status
  4. Click "Create New Appeal"
  5. Provide available details for the appeal
  6. Click Submit

What information can I collect about the appeal?

Appeals data is categorized into three sections: Appeal Details, Hearing Details, and Final Appeal Outcome. 

Appeals Details

Appeal location
The office in which the appeal is occurring. If entered when the license is denied or closed, this information will  automatically populate. This list is customizable by your Customer Success Manager. 
Agency representative
Representative for the agency in the appeal process. Options include: State Lawyer, County Lawyer, Court Appeals Officer, or Other.
Date appeal started
Date that the applicant confirmed they want to appeal the license decision.
Date approving agency
notified
Date the agency making the licensing decision was notified about the appeal.
Date appeals body
notified
Date the appeals body (ex: state administration offices) was notified about the appeal.
Date documentation
sent to appeals body
Date the agency submitted required appeals documentation to the appeal body.

Hearing Details

Pre-hearing date
Date of the appeal pre-hearing. This field is optional.
Pre-hearing notes
Optional notes pertinent to the appeal pre-hearing.
Hearing date
Date of appeals hearing. Multiple hearing dates may be added.
Hearing notes
Optional notes pertinent to the appeal hearing.

Final Appeal Outcome

Appeal outcome date
A description list is perfect for defining terms.
Appeal outcome
The official outcome of the appeal process. Options include:
Abandoned, Overturned, Upheld, Withdrawn by agency, Withdrawn by applicant, Withdrawn with conditions.
Conditions
When an appeal is Withdrawn with conditions, the conditions can be listed here.
Appeal outcome notes
Optional notes pertinent to the appeal outcome.

How do I know if a caregiver has an active appeal?

A caregiver with an active appeal will have an "Appeal in progress" indicator underneath their name on the Caregiver Applications dashboard.

How do I manage an existing appeal?

To manage an existing appeal, follow these steps:

  1. Locate the caregiver with an appeal on the Caregiver Applications dashboard
  2. Navigate to Actions > Change Application Status
  3. Click "View Appeal"
  4. Click the pencil icon to edit sections
  5. Click Submit

How do I finalize an appeal?

To finalize an appeal, the "Final Appeal Outcome" section must be fully complete.

  1. Locate the caregiver with an appeal on the Caregiver Applications dashboard
  2. Navigate to Actions > Change Application Status
  3. Click "View Appeal"
  4. Click the pencil icon in the Final Appeal Outcome section
  5. Enter required information
  6. Click Submit

After completing these steps, an "Appeal Finalized" indicator will be visible on the Caregiver Applications dashboard.

Can I have multiple appeals?

Yes, Binti allows multiple appeals to be recorded; however, only the most recent appeal will display on the Change Application Status page. To view historical appeals, view the License Appeals report.
